Whats the back story ?

At least 2 trips around the horn on the Samba.

It's actually $9K, obo. It'd be a ground-up project, but it could probably be had for a lot less. That's getting down there into "really cheap" territory.

The turtle-back is very cool, IMHO.

I agree with Rusty that it has a nice stance.

The back story is that the car has been for sale since before I purchased my car a year ago.  It's always been a little bit rough around the edges, but with some work it may turn out to be something much nicer.

I find it odd (possibly a warning sign?) that it's been 'sold' and then 'not sold' more than once over the past year.

hey guys the car is mine   and now it is down low in price  the guy who bought it and gave a deposit now says he does not need another project     after he tied it up for 60days ----never even came to look at it ---and after about 10 ph. calls asking when we can get together-----its a project  as far as the frame is concerned i want to make it clear ---the frame is basically a vw down the middle but with tube frame out riggers --it is simple nothing off the wall just replacing vw pans with a subframe made out of square  tubing instead of the vw floor -----hope this clears things up ---i just need the money for some of my wifes hospital bills   never thought i would be in this situation but i am   ---it has got so much potential and just not run of the mill ----thanks dennis ----973--714--3175

that is correct it did have a screwed up title --infact i bought with no title at all just a bill of sale --i thought it would be easier  ---and it was   it now has a clear new jersey 1957 title --title is clear and no problem   hope this clears things up its a great little car for the price     dennis   973-714-3175

hey guys need to sell --wifes hospital bills driving me nuts just need to clean some of them up ---next step will be ebay ---I do not want to go thru that again --seams like people bid and never follow thru ( buy and never even  come and look at it and tie it up for 2 or 3 mos.   it has happened to me 2 times ----so give me a call and lets see if we can get this done ---my loss is your gain --- ---973 714 3175 ---make offer all I can do is say no ---save me  from the ebayers that want to know if the car is steel and does it have the original Porsche engine --NO JOKE --  thanks dennis----973 714 3175

hey guys check out the wheels ---they fit great and almost makes the paint look good   I know if I keep it I am going to get it painted again---remember it was not my idea  as I said a good friend decided to surprise me and boy did he --oh well he is still a good friend and a great guy ---but the wheels are really nice and the car has a solid stance to it ---not easy to achieve----

Nah, I only have room in my garage for one project car.

My goal with the questions is to clarify the offering. This one has a bit of a history to it. I just want to make sure that anyone considering this one has all the necessary info at their fingertips. No surprises. Etc.

ok so ted can sleep at night ---car runs and drives ---title is clear --car has an assigned serial  and a clear new jersey title in my name ---registration does not have to be up to date in this  state if not in use ---I will go over this again ---needs wiring --interior --and could use paint ----it is a project that is well on its way ---the wheels that now come with it  as of last night are the fuchs replicas----I sold my devin d and he wanted the  356 wheels ---when I say sold ---who knows ---so many people out there say yes ---leave a deposit and never follow thru ---getting a little tired of the flakes  that eat up your time ---but the devin guy at least came and looked at it and than said he was going to buy it ----the last 2 buyers just sent a small deposit on the speedster and never even came to look or met their obligation --hope this answers some of your questions --ted --sleep well ----dennis

I hope you're at least keeping the deposits.  Heck, I'd up the non-refundable deposit amount and not give a hoot if they ever pick it up. LOL

well one guy got full refund ---the 2nd guy who tied it up for 60days and than said he would only take it if the title was in my name so I went to the dmv stood in line and paid 350.00 to put it in my name and he is asking for his deposit back---if I sell it and since I sold the devin last night I am leaning towards keeping it --he will get what is left --I figure 10.37 cents--hmmmmm maybe that's to high --I think I added wrong ---

A deposit is a commitment to buy. If somebody breaks the commitment, the deposit is non-refundable. Otherwise, you end up playing this game.

I don't mind the "B" nose, and the turtleback is very, very cool. The black Randar wheels looked kinda' cool with the silver. That car would look really nice with a smooth (all over) silver paint job, some EMPI Torque-Thrusts in gun metal, and a bomber-seat and truck-bed liner interior. Kinda' Hoopty-esque.

... and a BIG 'ol Type 4 out back.

I just sold my 911 on eBay this weekend and the guy says, do you want me to wire over the full amount next week and forgot deposit to which I said...pay the deposit.  It's non refundable as per the ebay ad.  I am one of the lucky ones.  He paid the deposit, took my bill of sale, wired the remainder on Monday and waiting on him to pick up.

They em don't all go this well that's for sure...and it ain't over yet until the minute it leaves my driveway!

Not surprisingly, contract law is more complicated than the posts above would indicate.  To begin with, contract law is usually written under the laws of a specific state, i.e, the contract may read: "this contract is written under the laws of state X.  If any provisions herein are found to be in violation of those laws, that provision shall be stricken, and the remaining provisions will remain in effect."

Different states handle deposits somewhat differently, but most agree that a deposit is used to provide the party not in breach with expectation or liquidated damages.  What that means is that the party who suffered the loss can be made whole, but not make any more profit than he would have if the contract was completed.

So, if the contract was for $10,000, and the profit to the seller was going to be $1,000, then a non-refundable deposit of $4,000 would likely be found unenforceable.  OTOH, if the deposit was $1,000, the court would likely find it enforceable, barring some other legal defect.

Most of us find the prospect of dealing with attorneys distasteful.  The internet has changed the availability of legal information to laymen.  If you are so inclined, Google "contract for sale in state X" to see what provisions should be present in a contract you write yourself.  Contract disputes can be a PITA, but almost all contracts are fulfilled without professional legal intervention.  All of us can do a little research and become familiar with the basics.  For those who want more info on legal self-help, Nolo.com is the national leader in publications that help consumers develop legal skills.

I've bought and sold half a dozen cars on ebay. All of the transactions were smooth- except the last. I didn't ask for a deposit, and I agreed to meet a guy from Oklahoma half way in rural Missouri. I drove the car down, along with my Dad in another to drive me back. When I got there, the buyer started backing away REALLY hard from his "eBay legal commitment to buy". He had me over a barrel-- gas was about $5/gal at the time, I was 4 hours from home, and had driven two cars and wasted an entire day (for two people) for this sale. In the end, the buyer nicked me horribly because I didn't want to take both cars back home and start the whole thing all over.

I'll never sell something online again without a non-refundable deposit. $1K wouldn't have covered the gas and time involved in the whole thing, but it would've made it more palatable.

I appreciate the information, Jim. You know more about this than I'll ever hope to.

So true. I learned the hard way on that one. I foolishly treated a deposit as an intent to buy with a right to back out -stupid. WTF was I thinking? I jumped into a deal once throwing down a deposit like a drunken sailor. After having second thoughts I was a little put off that I lost the deposit -fair but still stung. Now, a little smarter (I said a little right?), I only put down the absolute minimum deposit to get my foot in the door but also minimize the pain should things fail. A loss of cash and a bitch slap is still one of the best educations.

As long as we're telling bad experiences selling cars….

Way back when I was selling my '68 911S Targa (you know, the one I posted a pic with me styling a banging 'fro and Angel Flight bellbottoms) I drove it a distance to meet a 'serious' buyer. Selling price was $5K (agreed price). Buyer says he only has $4.5K with him (really, dude?). So, I take a soft stance and say 'OK, I'll take the $4.5K and keep the pink until I receive the $500 balance'. Deal, he drives away with my P-car.

You already know what happens, 7 months pass I never hear from the guy. UNTIL…I get a call from that ass-clown. He says car was stolen, but luckily was recovered (with no damage) by police. However, impound yard would NOT release P-car without pink slip. So, ass-clown asks if I would meet him at impound yard (again a pretty good distance to drive) with pink slip & he'll pay $500 balance.

MUSBJIM calmly says 'Sure, I'll meet you with pink slip, but NOW it'll cost you $1,000 or I will claim the car and take possession'.  Ass-clown angrily protested with many f-bombs. To which I replied 'Oh, did I say $1,000? I meant to say $1,200'!

On my way home I treated me & my rather LARGE Samoan homie (of course I brought him with me) to a nice steak & lobster dinner with some of that $1,200.

OK GUYS ---THIS IS MY CAR AND I UNDERSTAND PEOPLE GIVING DEPOSITS AND SO ON --AND I THINK A DEPOSIT IS A COMMITMENT TO BUY---BUT EACH CASE IS DIFFERENT ---WE ALL MAKE MISTAKES AND WE ALL HAVE SECOND THOUGHTS AFTER PURCHASES---BUT WHEN SOMEONE MAKES YOU SPEND MONEY TO PUT TITLE IN YOUR NAME WITH A SMALL DEPOSIT AND ASKED YOU TO STAND IN LINE FOR HOURS AND THAN CANCELS ON YOU AFTER 60 DAYS ON TALKING EVERY 2 OR 3 DAYS ---THATS GUY IN NOT GETTING DEPOSIT BACK ---I BELIEVE LIFE IS FAIR ON BOTH SIDES ----I ALSO UDERSTAND CHANGING YOUR MIND BUT NOT WHEN YOU PUT SOMEONE OUT ---WE ALL WORK HARD FOR OUR MONEY AND NO ONE WANTS TO  LOSE IT --BUT LETS BE FAIR -- AND I DID NOT SELL IT ON EBAY  ---I SOLD IT ON   SAMBA ----LIVE AND LEARN  ----DENNIS---PS SORRY ABOUT THE CAPS ---DID NOT LOOK UP UNTIL LATE --NO BODY YELLING
